The Department of Justice has revised its regulations effective January 18, 2017 as they relate to implementing a section of the Immigration and Nationality Act (INA) concerning unfair immigration-related employment practices.
The revision sets forth the three forms of prohibited unfair immigration-related employment practices: (1) Discrimination with respect to hiring, recruiting or referring for a fee, or discharging an individual; (2) intimidation or retaliation; and (3) unfair documentary practices. The revisions intention is to clarify specific parameters of conduct that constitute unfair documentary practices.
